These Terms of Service ("Terms") govern your access to and use of the Athletes Launch platform and its TikTok integration (the "Service"), operated by Dunk Mama Media LLC doing business as Athletes Launch ("we," "us," or "our"). By creating an account, connecting your TikTok account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Athletes Launch is a Name, Image, and Likeness (NIL) platform that helps college and amateur athletes manage their brand, connect with brands and collectives, and publish content. The Service integrates with TikTok to display your profile and content and to let you upload and publish videos to your own TikTok account at your direction.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and capable of forming a binding contract to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

3. Connecting Your TikTok Account

• You authorize the Service to access your TikTok data through TikTok's official APIs and the scopes you approve during login.
• You may disconnect at any time within the Service or by revoking access from your TikTok settings.
• You are responsible for the content you choose to upload or publish and for ensuring you hold the rights to it.
• Your use of TikTok remains subject to TikTok's own Terms of Service and policies.

4. Content You Post

You retain ownership of the content you create. By using the Service to publish to TikTok, you grant us the limited technical permission needed to transmit that content to TikTok on your behalf. You agree that content you publish will:

• Comply with TikTok's Community Guidelines and Content Sharing Guidelines;
• Accurately disclose commercial or branded partnerships (including NIL deliverables) using the disclosure controls provided;
• Not infringe intellectual property, publicity, or privacy rights of others;
• Not be unlawful, deceptive, harassing, or otherwise objectionable.

5. Acceptable Use

You agree not to:

• Use the Service to violate any law or the rights of any third party;
• Attempt to gain unauthorized access to the Service, other accounts, or TikTok systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Reverse engineer or misuse the TikTok APIs accessed through the Service in violation of TikTok's developer terms.

6. Intellectual Property

The Service, including its software, design, and branding, is owned by Dunk Mama Media LLC and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that content will always publish successfully to TikTok, which is subject to TikTok's systems and policies.

8. Limitation of Liability

To the maximum extent permitted by law, Dunk Mama Media LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service.

9. Termination

You may stop using the Service and disconnect your TikTok account at any time. We may suspend or terminate access if you violate these Terms or if required to protect the Service or its users. Upon termination, the license granted to you ends and we will handle your data as described in our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the Service. Continued use after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the United States and the state in which Dunk Mama Media LLC is organized, without regard to conflict-of-law principles.
